"It's not a valid choice when one of the options is counter to eBay's service policy."

Valid or not, it was a choice. I agree that he should not be charging PayPal fees, but when the whole episode is finished I'll bet you feel less satisfied than had you just sent a money order.

As far as eBay feedback is concerned, be very careful. If you leave a negative feedback for him, the seller is free to leave YOU a negative, giving his side of the story. This is a 'retribution negative'. You then have that mark against you, and aside from a lengthy court battle (complicated in international issues) there is nothing you can do.

Good luck, and I hope it turns out OK.

Inform both Paypal and Ebay in no uncertain terms that you are not happy and you have requested a refund and they guy has ignored you. All he has to do is click "refund" from his paypal account and its done with no fees anywhere.

One of my pals is the head guy at a huge customer service operation and they always take care of those that scream the loudest and longest the best.

Give up on getting the camera. Get your money back now. Another camera will come along, THey always do......

I think people generally look more for the negatives than the neutrals. Either this guy is sending me the camera or I'll post a kamikaze feedback*. Although it won't make any difference because eBay might suspend his account for doing this surcharge silliness.

* Kamikaze feedback = Negative feedback with 100% chance of generating retaliatory feedback.

Scott, you work at a bank? You keep saying that as if the moral of the story was "Next time, send a money order instead of fighting for your rights".
Imagine where civil rights would be if Rosa Parks had sent a money order and...never mind.

Pay the 7% and enjoy using your bargain-priced Fujica. You may well discover that while Paypal/eBay has a rule against extra fees in your country, they may not have a similar rule in Germany.

And your inability to read German is the reason that you didn't know what his conditions were up-front -- that's not the seller's fault when you bid on an item advertised in German on a German site. There are plenty of people here who would gladly help you translate anything that isn't crystal-clear.

You should also report this guy to both Paypal + eBay just in case his surcharge is not allowed, but don't expect much to happen.

I understand what you are doing, and why you are doing it, but many times it's just more trouble that it is worth. When I come across someone advertising their auction with unfair terms, like he did, I just move along. I figure the best punishment for his poor business practices is to receive one less bid. If everyone ignored the auctions with terms like this one, the seller would be forced to change their policies, or stop selling.

I'd rather pay a bit more to a fair seller, than waste my time running in circles with a-holes.

And no, I don't work for a bank. :)

This reminds me of a similar situation at my local convenience store. They were charging 25 cents extra if you paid for cigarettes with VISA, in an attempt to cover their fees. They stopped doing that, but they no longer get my business.

I highly recommend NOT suggesting "legal problems" - if you want to take legal action, the best way to do it is just to do it, not threaten it.

lunni wrote:Arislan, seriously I cannot see what your problem is. I do understand it's against ebay rules to charge paypal fee from buyer, but you knew he was going to do that before you placed your bid, right?
He wrote it in german. My grandparents are german, but I myself am not. He might as well have written "Wann ist das git nunstruck und slotermeyer? Ja, Beiherhund dass oder wer die flipperwald gersput."

He could also have said "send my payment in cocaine", it doesn't make it within eBay rules.
I do not have any German in my family but I did a quick Google translation and it is clear to me he is charging for PayPal fees. This is already a warning sign and you had the choice to ask questions, make a deal with him, or don't bid at all.

Granting that this is illegal in eBay rules, that is beside the point. You still can report it to eBay without placing your bid and not bid and later on cry foul!

Thanks to ALL who responded on this matter, I believe everyone of you had valid points and ideas on the matter, even those of you who disagreed with the way I went about it.

Herr Stoll told me he sent the camera today, probably after getting warned by eBay, but we will see. He sent it through DHL cheap parcel. But the drama is not over yet. It still needs to get through brazilian customs, which might mean another $300 USD in taxes. I should have had it sent to my family back home in DC, but I didn't realise this USED camera was a taxable item when I completed the address info. If the customs crooks charge me that much I might have to attempt to forward it to my US address....ah, I always make the best choices, don't I?

Mirrorman, in what way was 393 euros a "bargain"? O_o

I really expected to find one for $250 or so..

It's a top of the line camera. Retro Enterprises in Tokyo charges 369,600 Yen ($3,200) for a brand new one, 246,600 Yen ($2150) used:

Super 8 Camera Shop in Germany has one listed for 450 euros, which seems like a fair price as well.

I've seen it in flea markets in San Francisco for $40, I passed at the time because of the difficulty in getting Single-8 film. I lived to regret my mistake, because now we can buy from Kent. 8)

Ya, Super 8 Camera Shop, I know about that one. After the whole issue with Andersens Tears I decided to avoid business with Uhrmeyer.
