Yeah-that's all completely sickening. You can definitely get his name removed from that magazine. I sometimes sell camera gear, and I don't consider that payment mine until the customer tells me that they are completely satisfied. I have only had one camera returned once-it was about a month after the fact, but I still took it back. I was a very, very poor student back then, I just didn't have the money to cover what he had paid by that point (he said he was satisfied, but then changed his mind) so I went down to the bank and got a friggin' loan just to pay him and make everybody happy happy. I imagine an illustrious GP can scrape together 1600bucks in the same manner.

What an asswipe. That line of bull about having 'spent the money already' doesn't matter. How did you pay him? I always use a credit card for these kind of transactions where there's a possibility of dealing with a seller who is dishonest and deceptive.

Another very good point to bring up in court, he doesen´t stand a chance in hell agains you with all his extremly wrong info he has given you about the camera.

I really don´t expect it to have been altered to crystal when you think about his behaviour and descriptions about the camera that don´t tell you the reality. I bet he just grabbed the "crystal" out of thin air, just to make you more interested and to get a higher price for it.

He don´t give a shit if it is crystal or not, he doesen´t care if the viewfinder is the one he described, if the lens is scratched or if the camera is full of rust. So wy should he care about it being crystal or not? :evil:

This "Doc" is a nut case. He's absolutely 100% in the wrong no question...

Looks like you're both in Australia. If your current E-mails don't get your money back, I'd tell him you're paying him a personal visit at his office. I'd also say you're going to contact whatever medical association that regulates Australian doctors, like the AMA here in the US, and voice your concerns about his business ethics. You might also mention contacting the local press and law enforcement agencies in his city regarding the incident.

The thing to do is "threaten" his character and integrity. As long as you're 100% honest with the facts in doing so, you're within your legal rights. The truth is on your side. If he's such a prominent doctor, threatening to do the above should shake him in his boots...

In Austraila, you can take action through the civil courts by filing a minor civil claim for damages not exceeding $6000. This is the route I'd recommend. Costs are minimal, and you do not need to be represented by a lawyer. Don't know where you're located, but see the following link as a starting point:

A friend recently went through a similar process here (in Canada), and the claim was settled before going to court - the other party knew they were in the wrong and didn't want the humiliation of a court order.

There's little point wasting your breath arguing with this individual. Far better to simply slap him with a statement of claim. Make sure you have your paperwork in order, and get a friendly camera shop to give you an appraisal that clearly indicates the equipment is not as advertised.

Thanks for all the responses guys, it's reassuring to know I'm not alone in thinking I've been had by this guy. I've been doing some research these last few days (something I should have done at the start) and am finding his reputation to be less than stellar with many dealers throughout Australia.

Mark, not wanting to drag you into this but would it be possible to get copies of these e-mails with dates etc? Anything I have against this guy is going to help and I already have another two e-mails from disgruntled ex-clients of Ian's that back up what I'm saying. I really want to hit this guy with a barrage of irrefutable proof, maybe if I can do this and he realises he's screwed he'll do the right thing and give me a refund.

This is something I really don't understand. I've had the camera for a week (less than a week when I contacted him for a refund), it wasn't sold to me "AS IS", it wasn't the camera he described, he tells me someone offered him $2000 for it and his camera is far more valuable and easy to sell than any of the equipment I initially offered him as trade...he's also stated he's a very wealthy doctor and can't afford the cash, yet me being a student living off $200 a week can?!

It's not like I've just changed my mind or am being unreasonable here nor can I imagine anyone on the face of the earth apart from this nutjob claiming differently.

I'm going to write him one last e-mail to try and settle this like gentlemen, if he refuses then I'll be filing a minor civil claim for damages.

Tim - I've learn that my anonymity on the internet is rather important as it's caused problems for me in the past people knowing my real name so... there are quite a few people here that do know me personally but in general it's something I'd rather keep out of public forums. If Ian reads this he's going to know who I am and I've stated my first name more than once so I'm not really being that Anonymous :wink:

Clive - I didn't get the MST motor. All I wanted from the "package" was camera and lens, I was actually saving to get a motor from you but that now seems rather pointless.

leadlike - Yep, I know exactly what you're talking about. I've actually sent equipment to people before they've paid for it so they can test it out and make sure it's what they are after etc before paying in full (right Bon? :wink:). I also keep the money at hand for 28days after that incase something happens or comes up they want a refund for. I've been duped so many bloody times it's important to me that a customer is 100% happy and I go through great lengths to assure this.

It's just really sad for me when someone puts on a friendly and honest facade only to turn around and act like this. Even know he thinks he's done nothing wrong and actually did me a favour! Right, whatever...

Sorry if I can't post as often as I'd like, I haven't my own internet connection at the moment so it's often difficult to get on.

I'll keep you all posted though.

So how did you go in your legal struggle against the doctor, Anonymous? You certainly had a strong case against this guy. Were you victorious in the end?
